Limited Warranty:


(1)    What Is Covered By This Warranty. Carter and Son Toolworks LLC (“Carter”), the seller of premium woodturning tools (“Tools”), warrants to the original consumer purchaser, whether such purchase is made directly from Carter or indirectly from a reseller (the “Buyer”), that the Tool covered by this warranty is free from defects in material and workmanship. The duration of this warranty is 20 years from the date of purchase of the Tool (the “Warranty Term”). If a Tool is returned to Carter in accordance with all of the requirements and procedures set forth below, then the costs of resending the Tool to Carter, all repairs (including parts and labor), any replacement Tool, and the return of a repaired or replaced Tool to the Buyer is without charge to the Buyer and is at Carter’s sole expense.

(2)    Warranty Procedures. If the Buyer discovers a defect in material or workmanship during the Warranty Term, Buyer must promptly notify Carter in writing and provide a dated sales receipt. In no event shall such notification be received by Carter later than six months after the Warranty Term ends. Within a reasonable time after such notice, Carter will correct any defect in material or workmanship, with either new or used replacement parts. If Carter is unable to repair the Tool to conform to the warranty, Carter will provide, at its option, one of the following: (a) a replacement Tool, or (b) full refund of the purchase price. THESE REMEDIES ARE THE BUYER’S EXCLUSIVE REMEDIES FOR BREACH OF WARRANTY.

What Is Not Covered By This Warranty. This warranty does not apply to: (a) defects caused by improper use or abuse of the Tool, (b) damage caused by use of the Tool for purposes other than those for which it was designed, (c) damage caused by repairs to the Tool made by anyone other than Carter, (d) damage caused by attachments or modifications to the Tool, (e) damage to the Tool during shipment, (f) damages or defects caused by any other foreseeable or unforeseeable misuse or abuse of the Tool by the Buyer.
Disclaimer of Warranty. No warranties implied by operation of law are disclaimed during the duration of the Warranty Term. UPON EXPIRATION OF THE WARRANTY TERM, CARTER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AS TO ANY AND ALL ASPECT OF THE TOOL. Some states or provinces do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

Limitation of Liability. IN NO CASE SHALL CARTER BE LIABLE FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES BASED UPON BREACH OF WARRANTY, BREACH OF CONTRACT, NEGLIGENCE, STRICT LIABILITY IN TORT, OR ANY OTHER LEGAL THEORY. Such damages include but are not limited to: loss of profits, loss of capital, savings or revenue, loss of use of the Tool, the cost of any substitute equipment, the claims of third parties, and injury to property. This limitation does not apply to claims for personal injury. Some states or provinces do not allow the exclusion or limitation or incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Time Limit for Bringing Suit. Any action for breach of warranty must be commenced within one (1 year) after the cause of action for breach of warranty has accrued.

No Other Warranties. Unless modified in a writing signed by both parties, this limited warranty is understood to be the complete and exclusive warranty agreement between the parties, superseding all prior agreements, oral or written, and all other communications between the parties relating to the subject matter of this agreement. No employee of Carter or any other party is authorized to make any warranty in addition to those made in this agreement.

Other Relevant Information. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. This warranty is void in the event that repairs are made by anyone other than Carter without prior written authorization from Carter. Terms and Conditions:

PRICES: Buyer agrees to pay the prices quoted by the Seller, and is responsible for additional applicable shipping and handling charges, taxes (including sales, use, excise, value added, or other taxes), and all other duties. Seller shall collect such applicable taxes unless Buyer submits a valid tax exemption certificate.
WARRANTIES AND DISCLAIMERS: Seller makes only such warranties as set forth in Seller’s Limited Warranty attached hereto and incorporated by reference herein. Seller’s makes no other express or implied warranties.
LIMITATION OF LIABILITY: Regardless of the theory of liability or form of claim, whether in contract, tort, or otherwise, SELLER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES  FOR HARM TO PERSONS OR PROPERTY RELATING TO THE SALE OF GOODS SUBJECT TO THESE TERMS AND CONDITIONS. Any action based on any claim, regardless of the legal theory alleged, must be commenced and prosecuted within one (1) year after the cause of action has accrued.

RETURNS: Seller shall accept returns of normal stock Goods for a period of sixty (60) days following shipment for the exchange or refund of the purchase price; but only if the Goods are in their original display tubes, and unused.
